2. The Services We Provide
In exchange for the fees you pay in advance, we will host your website on one or more of our servers, so long as you abide by the terms and conditions that are set out on this page, and in any other agreements that relate to the services we may provide you with. We will provide the services according to the specifications listed for the hosting package you select during the signup process. For clarity, on this page, the term "Services" refers to the web hosting and other services that we will provide you with .
3. Permission to Host Your Content
For us to host your website, it is necessary for you to upload a copy of your content to our servers (always keep one or more back-up copies for yourself). As you upload it, you are creating one or more copies of your content, Web site, web files and other data in our system. By purchasing hosting or other services from us, you acknowledge that these copies are being made, and give us the permission to maintain these copies and make them available to users of the Internet. You are solely responsible for providing all of the content and other data that make up your website, and for keeping back-up copies of those items.
4. When the Services Will be Available
We will attempt to provide the services 24 hours a day, 7 days a week for as long as you have paid for them. Sometimes, however, for a number of reasons, the services may be unavailable to you. You must recognize and acknowledge that due to the nature of web hosting technology, occasional unavailability of the services cannot be avoided. Sometimes there are equipment malfunctions. At other times we undertake periodic maintenance procedures or repairs. Still other times, there are causes beyond our control like power failures, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network traffic and other problems. We have not promised to provide you with uninterrupted service.
5. Personal Information
When you place an order for our services, your personal information, including your credit card information, is transmitted via the use of Secure Socket Layer technology, the industry standard for encrypting sensitive information. We take your privacy very seriously, and as such, will not sell your personal information to third party (other than a company that may purchase Just Host), and will take reasonable steps to keep it from being disclosed to any third party.
6. Cancellation
We offer you an Anytime Money-Back Guarantee on all hosting plans. Upon cancellation of your account, you may request a refund in 14 days after sign up. If you cancel your account in 14 days period we will refund all funds (verification of credit cards, bank transfers fees and so on), excluding any setup fees that were charged when you signed up, and excluding domain registration fees.
To unsubscribe from our services please email us: support@goodhoster.net, with your request. If you cancel your account after 14 days have passed, or after a prolonged period of validity of your orders, then, unfortunately, in this case, a refund is not possible. Please note: improving the hosting order, check (or transfer) of domains and SSL certificates, licenses, etc. non-refundable. Our policy on these services is as follows: starting to work, we do not refund the money.
7. Automatic update (renewal)
We provide automatic updates of the term of the order, a 14 days before the expiration of service; the system will send a notice to appear and the ability to manually create an invoice in the control panel orders and invoices. If during this period no payment will be made, the system for a week before the deadline will automatically create an account and send notification to your e-mail. If the bill was not paid by the end of their service, web hosting account is blocked for 14-60 days and then removed.
8. Acceptable Use / Illegal activity
GoodHoster.NET tries to maintain a high level of service. We do not provide services to those who use them for: Hacking, which includes for example penetrating or attempting to penetrate into another computer or network without authorization. Port scans, stealth scans, as well as "phishing" (a type of Internet fraud, phishing information to commit "identity theft"). Hosting files and other data that infringes on copyrights or intellectual property rights. Spam, or sending information to a large number of email users. We maintain a strict policy on spamming, which includes the mailing list of prohibited commercial e-mail using our services, or to support an open SMTP connection. We reserve the right to terminate or limit the services that you use for spam in any form.
Copy on the server, or links to any content that violates the rights of publicity or right to privacy.
The use of profanity and insults, or any other web-content pages, which is obscene, abusive, libelous or defamatory.
Hosting, storage or dissemination of pornographic nature. If any such content of this type will be discovered and taken us into consideration, the appropriate services that control these web pages will be notified.
Running malicious processes, file storage or other data, viruses that can harm the servers or the Internet users.
Interception of data or traffic that are not designed for the customer or his scripts.
Do not use the software on servers using the protocol BitTorrent, torrent clients, and the like.
Account or a domain name registration service can be disabled with a further deletion, if the customer have the wrong (false) information about yourself when registering or if obvious violations of the conditions of registration of the domain's zone or the laws of Ukraine.
If you use our services for any kind of illegal activity, we have the right to delete your account without the possibility of refund.
GoodHoster.NET reserves the right to suspend services if the work site / scripts the customer according to our administrators leads to excessive consumption of server resources, may cause it to fail, violates the stable operation of the VPS and other sites or may cause threat to the security server or other sites.
9. Resource Usage
Use of resources for shared hosting services:
Our shared services available to most customers, and it's time for some Web-sites, when they need a more expensive package of services that takes into account the relevant parameters (RAM, CPU, disk space), necessary for normal functioning of the Web-site.
Limitations of shared hosting:
CP-START - 5%
CP-4GB - 5%
CP-PRO - 5%
CP-MAXI - 10%
CP-START - no more than 1000 mails per day.
CP-4GB - no more than 1000 mails per day.
CP-PRO - no more than 1000 mails per day.
CP-MAXI - no more than 2000 mails per day.
It means if we find out that your Web-site uses more server resources than allowed, then we have the right to suspend your site and take it offline mode (shut down). You can order a virtual or dedicated server services for your Web-site, or require the conversion of paid services. Because of the seriousness of this fact and the need to respond quickly to the appearance / fix these situations to avoid server issues, we will do everything possible to pre-warn you of excessive use of server resources by your Web-site, but we do not undertake any obligation to do so.
Use of resources for VPS hosting services:
When ordering services VPS (virtual private server) the customer gets full root access to the server and have the initial Linux administration skills. While installing the VPS basic setup is carried out by the chosen hosting plan. Within 24 hours of receiving access to the virtual server, the customer can test the server and file their claims for work or server settings. After 24 hours, after gaining access, the customer is using a full root access to the VPS, bears responsibility for the virtual server, any malfunction, failure or error in the server and software. We assume no responsibility for the work of the VPS, after adjusting for VPS or install software by the customer or after any actions the customer, which could cause problems. Administrators control only the state of the physical server load and its resources.
Free VPS services include:
site transfer from another host after VPS order;
basic installation and configuration of standard software on the chosen hosting plan;
installation of control panels licensed from our company;
advice on the use of control panels, installing / configuring the standard software. The solution of simple errors on sites with our expert technical support;
reinstall the VPS with data loss is not more than 1 time per month, VPS reinstall on request;
Additional administration costs $ 30 per hour of work a specialist technical support to clients located NOT on the server of our company and $ 20 per hour for clients using our servers. Minimal administration time 30 minutes costs $ 10 for GoodHoster.NET servers and $ 20 for servers of other companies. Carried out time is determined by the tech support specialist.
Use of resources for dedicated server:
We provide our clients to rent a dedicated physical server with Internet connection and full root access. The amount of allocated bandwidth and unlimited traffic conditions described for each service plan on the order page dedicated servers of our site. Servers are offered with free administration and with basic administration. Server administration is engaged in contracting on their own, help of our specialists is available only on pay administration.
Free offers without the administration:
Assist in the transfer of up to 10 sites from another host server when ordering;
Basic installation of standard software;
May be given advice on the control panels or errors / problems of the site for free at the request of administrators;
Reinstalling the operating system with data loss is not more than 1 time in six months;
Access via KVM available on request.
The basic administration includes:
Installation, server configuration, basic optimization / upgrade software for greater productivity and better work of sites;
Assist in the transfer of any number of sites from another host;
Advice and assistance on the use of control panel functions, decision issues / bugs of the software or on web sites;
Set up resource monitoring and notification server, at the discretion of the Administrator (on the complexity of work) to install and configure an additional non-standard software;
The time of server management by our experts should not exceed 4 hours per week. Time limit is set solely in order to avoid misuse services administrators. Administrators can increase the time limit to solve customer requests at its own discretion.
10. These Terms of Service May Change
Due to our evolving business, and the changing nature of the web hosting industry, these terms of service may change. We will post the changes here, and they will take effect when posted; your continued use of the service means you accept the changes we have made.
11. DMCA Copyright Infringement Information
In accordance with the Digital Millennium Copyright Act, we have adopted a policy to suspend or terminate the accounts of website owners found to be in violation of copyright. We respect the intellectual property of others, and we ask you to do the same. We may, in appropriate circumstances and at our discretion, disable and/or terminate the accounts of users who may be repeat infringers. If you believe that your work has been reproduced (copied) to a certain extent, that violates the copyright, or your copyrights have been violated, please provide the following information to e-mail: call@goodhoster.net
an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
a description of the copyrighted work or other intellectual property that you claim has been infringed;
a description of where the material that you claim is infringing is located on the site;
your address, telephone number, and email address;
a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
12. Technical support
One of our goals - is to provide professional support at a highest level. It is the responsibility of technical support includes support for continuing the work site the customer 24 hours a day, when it comes to commissioned services, assistance in solving the problems associated with features of server configuration, providing advice on services.
Specialist technical support is not required to perform the actions that the customer can make their own by providing instructions or control panel. If the customer refuses to manage hosting accounts using the supplied functions in the control panel and any other features or refuses to perform any action on the request or instructions, technical support in the law does not produce the desired action rather than the customer.
With inadequate communication or use of obscene language customer requests can be deleted without response, and we reserve the right to block granted to the customer service.
13. Compensation
If GoodHoster.NET sued or threatened litigation against third parties due to the fact that you did something while using our services (deceit, fraud), you are obligated to pay the costs to settle the dispute, if GoodHoster.NET decides you are responsible for the problem occured. In legal terminology, this concept is called "compensation". Not only do you have to agree to compensate GoodHoster.NET costs of meeting the court order or settlement, but also must agree to pay the reasonable expense for GoodHoster.NET counsel and cover costs that are incurred during GoodHoster.NET his defense.
14. Denial of warranty.
GoodHoster.NET flatly refuses to provide any kind of warranty, whether express or implied. Services are provided on the guiding principle "AS IS" AND "AS AVAILABLE". GoodHoster.NET does not guarantee that services will meet your requirements, as well as to run smoothly, regularly, reliably and without errors, and failures will be corrected. GoodHoster.NET not guarantee and does not accept any complaints regarding the use or the results of any services provided that they are correct, accurate, reliable operation, etc.
15. Limitation of Liability
IN NO EVENT SHALL GoodHoster.NET BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFIT OR GOODWILL, FOR ANY MATTER, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF WARRANTIES, EITHER EXPRESS OR IMPLIED, ANY BREACH OF THIS AGREEMENT OR ITS INCORPORATED AGREEMENTS AND POLICIES, YOUR INABILITY TO USE THE SOFTWARE OR SERVICES, YOUR LOSS OF DATA OR FILES OR OTHERWISE, EVEN IF GoodHoster.NET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some states may not allow such a broad exclusion or limitation on liability for damages as contained in these terms of services. In those states, our liability is limited to the full extent permitted by law. You agree that in no event shall our maximum aggregate liability exceed the total amount paid by for the services in dispute purchased from us, or, in the event of liability of GoodHoster.NET due to your enrollment in the program.
This Agreement shall enter into force as soon as you place your order on our services or open an account on any Web-hosting services we provide. If you are an existing customer and do not agree to these terms, please cancel your account. So, if you sign up, or continue to use our services, this will mean that you accept these conditions here.
